A federal judge sentenced former New Jersey U.S. Senator Bob Menendez January 29th to 11 years in prison for corruption charges and acting as a foreign agent. Menendez, a Democrat, was contrite in the courtroom, but blasted the process as “political,” and “corrupted to the core” in a not-so-subtle appeal to President Donald Trump.

Menendez was convicted July 16th on all federal charges of conspiracy, bribery, extortion, wire fraud, obstruction and acting as a foreign agent in schemes involving an Egyptian-American businessman and a New Jersey developer.   

In exchange for cash, a Mercedes convertible, and gold bars, Menendez used his influence as chair of the U.S. Senate Foreign Relations Committee to procure exclusive import of halal processed meat products into Egypt.  The New Jersey Monitor reports that Menendez then signed off on billions in U.S. military aid to the government of Egypt, despite the country’s deteriorating human rights record.

But times have changed.  February 11th, the U.S. Justice Department ordered the Southern District of New York to drop bribery and corruption charges against New York City Mayor Eric Adams.  He was accused of taking illegal campaign donations from foreign nationals and businessmen, and doing favors in exchange for luxury travel. The apparent quid pro quo with the Trump administration prompted six SDNY attorneys to resign in protest.

Our recent reporting explored the massive contributions to Donald Trump’s inaugural fund, reportedly reaching $170 Million dollars.  What are the rules as to how that money is spent?  The short answer is, there aren’t any.

The Federal Election Commissions allows private donations to support inaugural activities.  This year, that’s a parade, a rally, two luncheons, a tea, three dinners, three inaugural balls, and fireworks at Trump’s Sterling golf club.  The FEC requires reporting of donations over $200 dollars, but sets no limits or dictates how it’s used. Of the known inaugural donors, crypto platform Ripple has contributed the most, at $5 Million dollars. 

Taxpayers foot some of the bill, including security for the inauguration itself.  Let’s say that the Trump inauguration has 12 events, and they cost an astronomical $2 million dollars each – a whopping $24 Million dollars.  That leaves $146 Million left.  When the inauguration is over, will we know how the leftover money will be used? 

We won’t.  While a Trump campaign source told the New York Times some would be used for Trump’s Presidential library, there are no rules dictating how that money is used.  

The Inaugural Fund Integrity Act is expected to be re-introduced in Congress in January, which would set a limit of $50,000, require immediate disclosure of contributions over $1000, and ban corporate and SuperPAC donations.   But the legislation STILL doesn’t require disclosure of how that extra money gets spent.

Donald Trump’s inaugural committee has received $170 Million dollars in contributions, and it’s expected to reach $200 Million – almost double his 2017 total.  

Yes, the contributions pay for the inaugural balls, but inaugural funds are also a vehicle for corporate “pay to play” contributions, currying favor for federal contracts, lenient legislation, or access to the President. 

The Associated Press reported January 9th that the totals were far beyond President Trump’s $107 Million in 2017, and President Biden’s $62 Million in 2021.  

The Federal Election Commission oversees inaugural contributions, and any donation of $200 or more must be reported  – but 90 days after the contribution is made and long after the spotlight is gone.   There are no individual or corporate contribution limits, and only foreign nationals are barred from donating.  

Among the known 2024 inaugural donors, Amazon, Meta, Open AI Toyota, Ford General Motors and Boeing all made public statements when they donated $1 Million each.  Banking, pharmaceutical, and communications companies contributed seven figures, according to the Wall Street Journal. 

Energy company Chevron said in a statement to Reuters, “Chevron has a long tradition of celebrating democracy by supporting the inaugural committees of both parties.”  Or perhaps, they’re sending a message to someone.

New York City Mayor Eric Adams was denied access to over $4 million dollars in matching public funding for his 2025 campaign, due to questions over an ongoing federal investigation and accusations of financial mismanagement.

The U.S. Department of Justice filed charges against the mayor in September, charging him with taking campaign donations from foreign nationals and businessmen, allegedly using “straw donors” to make them appear as legitimate donations.  He is also accused of doing favors in exchange for luxury travel and attempting to conceal these transactions, according to the DOJ.

The New York City Campaign Finance Board ruled December 16th that Mayor Adam’s request for $4.5 million dollars in matching funds would be denied.  The chair of the board said in a statement, “After thoroughly reviewing all available information, including the details of the indictment of Mayor Adams, the Board has determined there is reason to believe the Adams campaign has engaged in conduct detrimental to the matching funds program, in violation of law, including the Campaign Finance Act and Board Rules.”

New York City’s campaign finance system provides an 8 to 1 match for small donations of $250 or less for mayor and $175 for city council.   Such small donor financing systems promote transparency, discourage big money influence, and encourage less affluent candidates to run.

A 2020 Alaska ballot initiative took steps to shine a light on dark money campaign funding. The U.S. Supreme Court just turned down a challenge to that law, and it may be good news for an expected case in Maine.

Alaska voters approved Ballot Measure 2 in 2020, which in addition to implementing open primaries and ranked choice voting, also took steps to disclose dark money funding of campaigns and ballot measures.

It requires candidates and ballot measure organizers to disclose the “true source” of funding for any contribution over $2,000 within 24 hours, limiting the ability of donors using 501c nonprofits and other entities to hide their identities.  For any group whose funding is 50% from out of state, a disclaimer must be added for all communications, including advertising. 

Claiming a violation of First Amendment rights, several groups and contributors sued, but November 18th, the U.S. Supreme Court turned down the case without comment. Great news for voters, and it also could bode well for Maine’s recently passed Question 1, limiting contributions to SuperPACs to $5,000 and requiring disclosure of those donations.  Organizers of that initiative expect it will be challenged, and think the U.S. Supreme Court majority could uphold a state’s power to regulate campaign finance contributions.
